In 2019, Sarah went into labour with her first child at a local hospital. Despite a seemingly normal progression, the medical staff failed to perform a timely caesarean section when it became clear that the baby was in distress.
The prolonged labour caused significant complications, leading to the baby being born with oxygen deprivation, which resulted in hypoxic-ischemic encephalopathy (HIE). The newborn, named Grace, required immediate medical intervention and spent several weeks in the neonatal intensive care unit (NICU).
“This was supposed to be a joyful experience, but it turned into a nightmare,” Sarah stated. “The settlement will help us cope with the ongoing medical needs of our child.”
The solicitor representing Sarah emphasized the importance of adhering to best practices and guidelines during labour and delivery. The €600,000 settlement aimed to cover Grace’s extensive medical expenses, including specialized care, therapies, and long-term support services. It also accounted for the pain and suffering experienced by both Sarah and her child.
The hospital involved admitted their failure and pledged to implement enhanced monitoring protocols and training programs for their staff. This included the use of continuous electronic fetal monitoring during labour, regular training sessions on recognizing and responding to signs of fetal distress, and immediate availability of senior obstetricians during high-risk deliveries.
